Agreement to Terms
Welcome to EaseHlp (operated by LYFTIndia Online Cabs Services Pvt Ltd). By registering, accessing, or using our platform at https://www.easehlp.com or our mobile / Web application, you acknowledge that you have read, understood, and agree to be legally bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, please refrain from using our platform.
1. Definitions
"EaseHlp", "Platform", "We", "Us", or "Our" refers to EaseHlp, operated by LYFTIndia Online Cabs Services Pvt Ltd.
"Customer", "You", or "User" refers to any individual or entity that registers on the platform and books services.
"Service Provider" refers to verified Maids, Drivers, Cooks, or other professionals listed and managed by EaseHlp.
"Booking" refers to a confirmed service request made by a Customer through the EaseHlp Platform.
"Services" refers to Driver, Maid, Cook, and any other home or personal services offered through EaseHlp.
2. Acceptance of Terms
By creating an account and using the EaseHlp platform, you confirm that:
- You are at least 18 years of age or the legal age of majority in your jurisdiction.
- All registration information provided is accurate, current, and complete.
- You will comply with all applicable local, state, and national laws and regulations.
- You have the legal authority to enter into a binding agreement with EaseHlp.
3. Platform Nature & Role of EaseHlp
EaseHlp is a technology-enabled marketplace platform that connects Customers with verified independent Service Providers. It is important that Customers understand the following:
- EaseHlp acts as an intermediary platform and is NOT the employer of any Service Provider.
- Service Providers listed on EaseHlp are verified, trained, and background-checked professionals registered with EaseHlp.
- The contract for actual service delivery is between the Customer and the Service Provider.
- EaseHlp facilitates the connection, scheduling, payment processing, and support.
- EaseHlp reserves the right to modify, add, or remove services from the platform at any time.
4. Strict Prohibition: Poaching of Service Providers
Critical Policy — Please Read Carefully
PROHIBITION ON DIRECT HIRING / EMPLOYMENT OF EASEHLP SERVICE PROVIDERS
Customers are STRICTLY PROHIBITED from directly hiring, employing, retaining, soliciting, or engaging any Maid, Driver, Cook, or any other Service Provider introduced or assigned through the EaseHlp Platform on their own private payroll or under any private, informal, or formal employment arrangement — whether during the term of their EaseHlp subscription or after its termination.
This includes, but is not limited to:
- Offering direct cash payments to Service Providers for private services bypassing EaseHlp.
- Retaining a Service Provider on a private agreement, with or without monetary compensation.
- Encouraging or inducing a Service Provider to resign from EaseHlp and work directly for the Customer.
- Referring EaseHlp's Service Providers to third parties for private employment.
CONSEQUENCES OF VIOLATION:
- A SUBSTANTIAL FINANCIAL PENALTY of up to ₹5,00,000 (Five Lakh Rupees) per Service Provider per incident will be levied immediately.
- PERMANENT ACCOUNT SUSPENSION AND BLACKLISTING from the EaseHlp platform, with no refund of any subscription or booking fees.
- CIVIL AND CRIMINAL LEGAL ACTION: EaseHlp reserves the right to file a civil lawsuit for damages and, where applicable, initiate criminal proceedings under applicable Indian law including but not limited to breach of contract and unfair trade practices.
- COURT CASE REGISTRATION: A formal complaint will be registered with the competent courts/authorities, and EaseHlp will actively pursue all legal remedies available under Indian Contract Act, 1872, and other applicable statutes.
By continuing to use EaseHlp, you expressly acknowledge this policy and accept full liability for any breach thereof.
5. Customer Account & Registration
You are responsible for:
- Maintaining the confidentiality of your account credentials.
- All activities that occur under your account.
- Immediately notifying EaseHlp of any unauthorised use of your account.
- Providing accurate contact and payment information during registration.
EaseHlp reserves the right to suspend or terminate accounts that violate these Terms, engage in fraudulent activity, or misuse the platform.
6. Booking, Scheduling & Cancellation Policy
6.1 Booking
Customers may book Services via the EaseHlp website or mobile application. All bookings are subject to availability of Service Providers. A confirmed booking constitutes a service agreement between the Customer and EaseHlp.
6.2 Cancellation
- Cancellations made more than 24 hours prior to the scheduled service time: No charge.
- Cancellations made within 2–24 hours of scheduled service time: A cancellation fee of up to 50% of the service charge may apply.
- Cancellations made within 2 hours or no-shows: Full service charge may be levied.
6.3 Rescheduling
Customers may reschedule a booking subject to Service Provider availability. Rescheduling requests must be made at least 4 hours before the scheduled time.
7. Payments & Pricing
- All prices displayed on the platform are inclusive of applicable taxes unless stated otherwise.
- Payments must be made through the approved payment gateways on the platform.
- EaseHlp accepts UPI, debit/credit cards, net banking, and wallet payments.
- Cash payments made directly to Service Providers, outside the platform, are strictly discouraged and EaseHlp bears no liability for such transactions.
- EaseHlp reserves the right to revise pricing at any time. Updated pricing will be reflected on the platform.
- In the event of a payment dispute, the Customer must contact EaseHlp support within 7 days of the transaction.
8. Service Standards & Quality
EaseHlp is committed to providing high-quality, verified professionals. However:
- All Service Providers are background-checked and trained before being onboarded to the platform.
- EaseHlp does not guarantee the results of any specific service.
- In the event of unsatisfactory service, Customers may raise a grievance through the app or website via email within 24 hours of service completion.
- EaseHlp will investigate complaints and take corrective action, including reassignment of a Service Provider, partial or full refunds at its sole discretion.
9. Customer Responsibilities & Code of Conduct
As a Customer using EaseHlp, you agree to:
- Treat all Service Providers with dignity, respect, and professionalism.
- Provide a safe working environment for Service Providers visiting your premises.
- Not record, photograph, or surveil Service Providers without their explicit consent.
- Not engage Service Providers in tasks that are illegal, hazardous, or outside the agreed scope of service.
- Not use abusive, threatening, or discriminatory language with Service Providers or EaseHlp staff.
- Report any misconduct by Service Providers promptly through official EaseHlp channels.
EaseHlp reserves the right to suspend or permanently ban any Customer who engages in misconduct, harassment, or abusive behaviour toward Service Providers.
10. Privacy & Data Protection
EaseHlp collects and processes personal data in accordance with its Privacy Policy available at https://www.easehlp.com/privacy. By using the platform, you consent to:
- Collection of your name, contact details, address, and payment information for service fulfilment.
- Use of your data for improving platform services, communications, and promotional offers (with opt-out available).
- Sharing of necessary data with Service Providers solely for the purpose of service delivery.
EaseHlp employs 256-bit SSL encryption and is committed to protecting your personal data from unauthorised access.
11. Intellectual Property
All content on the EaseHlp platform, including but not limited to the brand name, logo, website design, mobile application, text, graphics, and software, is the exclusive intellectual property of LYFTIndia Online Cab Services Pvt Ltd. Customers may not:
- Copy, reproduce, distribute, or exploit any content from the platform without prior written consent.
- Use EaseHlp's brand name or logo in any form for personal or commercial purposes.
- Reverse-engineer, decompile, or attempt to extract source code from EaseHlp's technology.
12. Limitation of Liability
To the maximum extent permitted by applicable law:
- EaseHlp's total liability to any Customer shall not exceed the amount paid by the Customer for the specific service giving rise to the claim.
- EaseHlp shall not be liable for indirect, incidental, consequential, or punitive damages arising from the use of the platform.
- EaseHlp is not responsible for any loss, theft, or damage caused by a Service Provider beyond the scope of EaseHlp's verified engagement.
- EaseHlp does not guarantee uninterrupted or error-free operation of the platform.
13. Indemnification
You agree to indemnify, defend, and hold harmless EaseHlp, its directors, officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including legal fees, arising out of or in connection with:
- Your violation of these Terms and Conditions.
- Your misuse of the platform or its services.
- Any third-party claim arising from your interaction with Service Providers outside the scope of EaseHlp's platform.
- Your violation of any applicable law or regulation.
14. Dispute Resolution
In the event of any dispute between the Customer and EaseHlp:
- The Customer must first attempt to resolve the dispute by contacting EaseHlp support at easehlp2026@gmail.com or +91 98866 43339.
- If the dispute remains unresolved within 30 days, it shall be referred to arbitration as per the Arbitration and Conciliation Act, 1996.
- The seat of arbitration shall be Kolkata, West Bengal, India.
- All legal proceedings shall be subject to the exclusive jurisdiction of the courts in Kolkata, West Bengal.
15. Governing Law
These Terms and Conditions shall be governed by and construed in accordance with the laws of India. Any disputes arising shall be subject to the exclusive jurisdiction of competent courts located in Kolkata, West Bengal, India.
16. Modifications to Terms
EaseHlp reserves the right to update or modify these Terms and Conditions at any time. Customers will be notified of significant changes via email or in-app notifications. Continued use of the platform after such notification constitutes acceptance of the revised Terms.
17. Termination
EaseHlp reserves the right to suspend or terminate your account and access to the platform at any time, with or without notice, if you:
- Violate any provision of these Terms and Conditions.
- Engage in fraudulent, illegal, or abusive behaviour.
- Attempt to poach or privately hire any EaseHlp Service Provider.
- Pose a risk to the safety or wellbeing of Service Providers or other users.
18. Subscription Plans
EaseHlp offers subscription-based plans for regular service usage. By subscribing:
- You agree to the pricing, duration, and service allocation specified in your chosen plan.
- Subscription fees are non-refundable once a billing cycle has commenced.
- EaseHlp may modify subscription terms with 15 days' advance notice.
- Customers may cancel subscriptions at any time, effective from the next billing cycle.
19. Safety & Emergency
EaseHlp provides 24/7 safety support. In case of any emergency during a service session:
- Immediately call emergency services (100/112).
- Contact EaseHlp's emergency support via the app or WhatsApp at +91 98866 43339.
- Do not handle disputes or emergencies with Service Providers personally without involving EaseHlp.
